Manifest Regulation

 

Dear Customer,

 

According to Decree No. 172 of General Administration of Customs of the Peopleí»s Republic of China, a new advanced manifest regulation will be implemented by China Customs in 2009. This new regulation requests submission of complete and correct electronic manifest data to China Customs 24 hours prior to loading of cargoes onto vessels out of and into Mainland China ports. That means that the regulation is applicable to all export, import and transshipment cargoes via any of the Mainland China ports.

 

To comply with the regulation and secure loading of your cargoes, COSCON, as one of the ocean carriers, will adjust some of our documentation cut off time accordingly. For more details please contact local COSCON representatives..

1.    What is the background of the new regulation?

To standardize Customs administration of manifest of inbound and outbound means of transportation, facilitate and safeguard international trade, China customs issued the í░Decree No. 172 of General Administration of Customsí▒ in March 28, 2008, requires submission of complete and correct electronic cargo manifest to China Customs 24 hours prior to loading of cargoes onto vessels out of and into Mainland China ports as of January 1, 2009. According to the present situation, the implementation of this new regulation at each China mainland port may be different. For details please contact local COSCON representatives.

 

2.    What is the scope of the new regulation?

l      It applied to all China mainland ports, excluding Hong Kong, Macau and Taiwan.

l      It applied to export, import and transshipment cargo, FROB (Freight Remain On Board) is not requested.

 

3.    What is the cut off time for data submission?

l      Entering China:

                       i.              Primary data items of original manifest submission: trunk line 24 hours, feeders from Hong Kong and Macau 2 hours, before vessel loading at oversea POL.

                    ii.              Secondary data items of original manifest submission: before vessel arrival at China mainland POD.

l      Out Of China:

                       i.              Primary and secondary data items of pre-stowage manifest submission: trunk line 24 hours, feeders to Hong Kong and Macau 4 hours, before vessel loading at China mainland POL.

                    ii.              Loading manifest submission: 30 minutes before vessel loading at China mainland POL.

 

4.    What procedure is needed for manifest amendment after submission?

l      Amendment before cut off time: send EDI amendment request to China customs directly.

l      Amendment after cut off time:

                       i.              To send both EDI and manual amendment request to China customs.

                    ii.              Requested documents in paper for manual process includes: Application form of manifest amendment; BL copy; paper form manifest with seal.

                 iii.              To arrange subsequent operation according to customs feedback message.

 

5.    In what cases can the manifest be revised after customs cut off time?

In any of the following cases, the manifest can be revised without any penalty:

l      Loss or damage of the goods caused by force majeure;

l      Part of or all export cargo in the manifest are shut out or shipped in a different means of transportation due to loading, stowing or other reasons;

l      The more-or-less amount of the bulk cargo is within prescribed limits;

l      Errors in data transmission caused by other objective reasons.

 

6.    What is the aftermath if the original manifest is failed to file?

If the goods or articles are not listed in the original manifest, the customs will not allow them to be loaded or may order to directly ship them back even they had been loaded at oversea ports. Customers are needed to complete the requested submission data before COSCONí»s documentation cut off time. COSCON will not load any shipment without getting loading permission from China customs, and such cargo will be rolled out to next available vessel subject to all associated charges and costs at shipperí»s expense.

 

7.    How many kinds of the customsí» feedback message ?

l      Accepted: Manifest is accepted by the customs successfully.

l      Rejected: Manifest data does not enter into customs database due to technical or logical reason.

l      Do Not Load / Discharge: Cargo is not allowed to enter China.

l      Pending for manual process: Need more documents in paper for inspection.

 

8.    What is the time requirement for customers providing manifest data?

To comply with the rule and secure loading of your cargoes, COSCON will also need to adjust some of our documentation closings to ensure that we have enough time for documentation and submission. Since this may affect your shipment handling cycle, please communicate with your overseas suppliers, buyers, vendors or logistic partners about the new regulation and requirements. 9.    What shall customer provide before the documentation closings?

The information should meet China customsí» relative requirements of the data elements, which mainly includes the following items:

l      Complete name and address of shipper, consignee and notify party

l      Place of receipt, loading, discharging and delivery

l      Cargo description such as the exact commodity name, quantity, , packaging types and weight

l      Container number and seal number
